Terms of Agreement

Amenity access is limited to those employee members of full time tenants within Stantec Tower who have been issued memberships to access the Amenities (as defined below) by completing the Membership Registration Package (as defined below) (collectively, the “Tenant Members” and individually, the “Tenant Member”). For liability and safety reasons, unless explicitly stated otherwise, non- Tenant Members, including but not limited to, spouses, children and/or friends of the Tenant Members, are strictly prohibited from using the Amenities at any time. Property Management has the authority to terminate the membership to access the Amenities for violation of this “Tenant Members Only” policy. Property Owners and Management will not be held liable for any persons that have accessed the Amenities without proper authorization and/or through a third party.

Privacy

As a commitment to protecting personal information this document will be handled in accordance with the provisions of the Personal Information Protection Act (PIPA) of Alberta. The Tenant Member hereby gives permission for Canderel Management (West) Inc. or its nominees, associates and affiliates or their employees, to collect any personal information contained in this document, maintain personal information already on file and to collect further information for the purpose of contacting the member by mail, fax, telephone and/or email.

Amenities Access Agreement Offerings & Conditions

Welcome to Canderel Management (West) Inc. amenity offerings, solely for the use of the tenant of Stantec Tower. We are thrilled to support the health, well-being and team building of our tenants by providing these amenities.

Membership

A membership registration package including, but not limited to, Membership Registration, Amenities Etiquette Terms & Conditions and a Waiver (collectively, the “Membership Registration Package”) is required to be completed prior to gaining access to the amenities located on level 4 of Stantec Tower (collectively, the “Amenities”). The Membership Registration Package can be requested from stantectower@canderel.com which needs to be completed and returned via the same email address. The membership provides access to the Amenities such as the fitness centre, tenant lounge and conference centre, located on the 4th floor of Stantec Tower.

Any change in personal information (name, address, health status) must be immediately reported to Canderel Management (West) Inc. by the Tenant Member when the change occurs.

Hours of Operation
Monday to Friday: 6:00am – 8:00pm (closed weekends and holidays)

Access – A privilege not a right

Your building access card will be programmed to give you access to the Amenity Space once you have completed the Membership Registration Package. Please swipe-in each time you visit the Amenity Space, even if you are coming through the open door behind another person.

The Amenities are private facilities for the exclusive use of the tenants. For liability& safety reasons non-Tenant Members, including but not limited to, spouses, children, friends, or outside personal trainers of the Tenant Members are not permitted to use the Amenities at any time, unless explicitly stated otherwise. Violation of a policy or unsafe use of the Amenities could result in suspension or termination of access to the Tenant Members.

AMENITIES

FITNESS CENTRE

Equipment – Not to be removed from facility
Cardio Equipment: includes treadmills, elliptical trainers, upright bikes, recumbent bikes, step machine and rowing machine.

Weight Training Equipment: includes a variety of pin adjustable weight equipment, squat rack, kettle bells, adjustable benches, free weights, and supplemental training equipment. Please do not drop weights.

Stretching/Quiet Area
Currently set up for stretching and low weight activity.

Change Rooms
Lockers are for day use only, those who occupy a locker overnight risk having their items from the locker placed in the Lost & Found. Lost & Found items not claimed within 30 days will be donated.

The Fitness Centre change rooms are equipped with basic toiletries including body wash, and a blow dryer for your use, along with towel service (towels not to leave the Fitness Centre).

Safety and Emergency Procedures

  • In case of severe injury or medical emergency, phone 911 immediately and notify Security at 780.424.3059.
  • Please wear clean exercise attire, free of holes, odors, or tears.
  • Closed toe and indoor runners must be worn when using exercise equipment – no exceptions.
  • Cameras are located in the Fitness Centre, with exception of locker rooms, for the safety and security of all
  • Do not bring large amounts of money or valuables to the Fitness Centre.
  • Canderel Management (West) Inc. is not responsible for lost or stolen items.
  • Non-Tenant Members, including, spouses, children, friends, or outside personal trainers of the Tenant Members, are not permitted in the Fitness Centre.

MEETING ROOMS

The meeting area has bookable boardrooms, complementary WIFI, video/phone conferencing capabilities, for the Tenant Members and their guests.

AMENITIES ETIQUETTE & CONDITIONS

FITNESS CENTRE

  • Scents – In consideration of others with allergies or sensitivities to scents, please refrain from using scented products in the locker rooms including: lotions, powders, sprays, and perfumes.
  • Disinfectant Wipes – Please use the disinfectant wipes provided to clean equipment seats, railings, machines, benches, and stretching mats after usage. Note: Disinfectant wipes are not to be flushed down the toilet.
  • Respect for Others – Show respect for others by refraining from using foul language or shouting. Loud grunting, yelling, and other disruptive behaviors are not permitted.
  • Equipment Etiquette – If completing multiple sets on a machine, please be courteous and let others work in sets during your rest period. Return all equipment to the appropriate location, place all dumbbells on the appropriate racks and plates to the pegs when you are finished. Do not drop weights!
  • Food and Drink – Food and beverages are not permitted in the gym, with the exception of plastic or metal water bottles, and water.
  • Dress Code – Indoor appropriate running/gym shoes are required at all times. No sandals or open toed shoes are permitted. Active wear must be clean and odor-free. No jeans or business wear to be worn while working out.
  • Mobile Phone Cameras – Please refrain from taking photos while in the gym and/or locker rooms.

TENANT LOUNGE / MEETING ROOMS

  • Food and Drink – Food and beverages (non alcoholic) are permitted to be brought into the lounge/conference centre. Please ensure to clean up when finished.
  • Respect for Members – Show respect for others by refraining from using foul language or shouting while within the amenities. Please be especially courteous to those using the conference centre.
  • Responsibility– Please ensure that the guests you invite to the amenities follow these terms and conditions. You must be present and supervise your guests at all times while your guests are within the 4th floor.
  • Tables and Chairs – Please ensure the tables and chairs are replaced to their original position after your booking is complete, as well as a reasonable level of cleanliness.
 

EMERGENCY PROCEDURE
In case of an emergency where alarm bells sound, follow normal building evacuations procedures. In the event of a life safety emergency, please call 911.

I understand that failure to comply with the above may result in a termination of my membership. I acknowledge and accept all of the Amenities Etiquette Terms & Conditions.

Release, Waiver of Claims and Assumption of Risk Agreement

In consideration of my being permitted to utilize the facilities and amenities (collectively, the “Amenities”), including but not limited to the Fitness Centre and Conference Centre, located at Stantec Tower, 10220 103 Avenue, Edmonton, AB (the “Property”), and to participate in activities and/or programs offered at the Amenities (collectively, the “Activities”) I agree to the terms of and to be bound by this Release, Waiver of Claims and Assumption of Risk Agreement (the “Agreement”).

  1. I recognize and am fully aware that my usage of the Amenities or participation in the Activities are strictly voluntary. I acknowledge and understand that by using the Amenities and participating in the Activities, I may be at risk of personal injuries (which may include, but not limited to (1) injuries arising from my use of any exercise equipment or machines within the Fitness Centre; (2) injuries arising from my participation in supervised or unsupervised Activities; (3) injuries or medical disorders resulting from exercising at the Fitness Centre; and (4) injuries within the Property, including but not limited to, the locker rooms, showers, dressing rooms, and patios), death, property damage, or loss (collectively, the “Risks”). I am aware of the Risks and have full knowledge of the nature and extent of the Risks associated with the Amenities and Activities.
  2. Having full knowledge of the nature and extent of the Risks associated with the Amenities and the Activities, I am freely and voluntarily assuming such Risks involved and in doing so I fully understand that I will be solely responsible for any personal injury, death, property damage, or loss sustained by me in connection with, or in any way resulting from, my use of the Amenities or participation in the Activities, due to any cause whatsoever, including without limitation, the negligence or gross negligence of any of the Released Parties. Specifically, I acknowledge that by using the Amenities or participating in the Activities I am fully responsible for all legal, medical and any other costs that may arise by virtue of my usage of the Amenities or participation in the Activities.
  3. I, for myself, my heirs, executors, administrators, successors and assigns and anyone who might otherwise have a claim under me, will defend, indemnify and hold harmless from, and hereby do knowingly and intentionally release, waive and forever discharge Canderel Management (West) Inc., D-IG Edmonton Lux S.A.R.L., and any other beneficial owner thereof and the respective partners, affiliates and subsidiary corporations of the foregoing entities and their respective officers and subsidiary corporations and their respective officers, directors, agents, insurers, board members, employees, volunteers, agent, independent contractors, assigns, successors, other participants and/or others acting on their behalf (collectively, the “Released Parties”) from any and all claims, demands, actions and causes of action, losses and/or injuries (including, without limitation, illness, injury and/or death) to any person, property or otherwise, judgments, awards, lawyers’ fees and costs arising from or related to or resulting directly or indirectly from:
    a. my use of the Amenities or participation in the Activities on the Property and occurring during said participation or any time subsequent thereto;
    b. my failure to abide by the terms of this Agreement or any inaccuracies or misrepresentation I have made under this Agreement;
    c. acts and/or omissions of any persons that I invited or allowed to be present at the Amenities or to participate in the Activities; and/or
    d. acts and/or omissions of any other member, guest, visitor, invitee or other person present at the Amenities or participating in the Activities, due to any cause whatsoever, including without limitation, negligence or gross negligence on the part of the Released Parties.
  4. I agree that, although the Released Parties have taken steps to reduce the Risks and increase the safety of the Amenities and Activities, it is not possible for the Released Parties to make the Amenities and Activities completely safe.
  5. I agree to abide by and faithfully follow all rules and instructions given by the Released Parties relating to the Amenities and Activities, as may be established and revised at any time, at the sole discretion of the Released Parties, or any of them. I acknowledge that my right to use the Amenities and participate in the Activities may be terminated immediately by the Released Parties, or any of them, if I fail to comply with such rules and instructions. I also understand and acknowledge that the Released Parties, or any of them, reserve the right to refuse my access to the Amenities or Activities if they deem necessary for any reason whatsoever.
  6. I hereby declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my usage of the Amenities or participation in any of the Activities. I agree to not participate in any physical exercise and/or other activities if I hereafter have any medical, physical, mental or emotional health condition that would hinder or prevent my usage of the Amenities or participation of the Activities or otherwise present a risk of harm to my health and/or well-being or that of any other guest, visitor, invitee or other person present at the Amenities or participating in the Activities.
  7. I confirm that if I have consumed any alcohol or drugs, I will not use any Amenities or participate in any Activities.
  8. I understand and acknowledge that I am always, at all times, responsible for any persons I invited or allowed to be present at the Amenities or to participate in the Activities. I agree that:
    a. I will ensure all such persons to understand and follow rules and instructions given by the Released Parties relating to the Amenities and Activities;
    b. at no times will such persons be present at the Amenities or participate in the Activities when I am not present; and
    c. I will be responsible for all fees and costs arising from or related to or resulting directly or indirectly from personal injury, death, property damage, or loss caused by such persons.
  9. I understand and acknowledge that the Released Parties are not responsible for personal property lost or stolen while members and/or participants are using the Amenities or are on the Property.
  10. I confirm that I am of the full age of eighteen years and that I have had sufficient time to read and understand this Agreement in its entirety. I understand that this Agreement represents the entire agreement between myself and the Released Parties. I, on my own behalf, am executing this Agreement freely and voluntarily without any compulsion on the part of the Release Parties.
  11. I am aware that by signing this Agreement, I am waiving certain legal rights which I or my heirs, executors, administrators, successors and assigns and anyone who might otherwise have a claim under me may have against the Released Parties.
  12. I agree that this Agreement shall be governed in all respects by and interpreted in accordance with the laws of the Province of Alberta. Further, this Agreement is intended to be as broad and inclusive, and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.
 

HAVING READ, UNDERSTOOD, AGREED WITH, AND ACCEPTED THESE TERMS, I HAVE EXECUTED THIS AGREEMENT TO BE EFFECTIVE IMMEDIATELY.
