1) The License shall commence on the date noted below and continues on a month to month basis until cancelled pursuant to the terms of this agreement.
2) The License hereby granted shall be terminable at any time on 5 days notice by either party.
3) The licence hereby granted is personal to the Licensee and may not be assigned nor may the License hereby granted or exercised by any person other than the Licensee.
4) This License is non-transferable and non-refundable.
5) The Licensee will use the Fitness Facility at its own risk and assumes all risk of loss and injury to property or persons while in the fitness Facility or while entering it or exiting therefrom, whether caused by the negligence of the owner, Canderel, and their agents, employees, officers or servants or otherwise howsoever.
6) The Licensee will not leave valuables in the Fitness Facility.
7) The Licensee will turn off showers after use.
8) The Licensee will inform Canderel of any damage which occurs in the Fitness Facility.
9) The Licensee acknowledges that Canderel has no obligation to supervise the use of the Fitness Facility.
10) The Licensee waives any and all claims, actions and causes of action which the Licensee may suffer while in the Fitness Facility or while entering it or exiting therefrom and covenants and agrees to save harmless and indemnify the owner, Canderel, and their agents, employees, offices or servants from the claims of any other persons with respect to such loss or injury ( which for the purpose hereof shall include death ) suffered by the Licensee while in the Fitness Facility or while entering it or exiting therefrom.
11) Any Licensee who abuses the use of his/her access card in any manner, such as admitting non-members to the Fitness Facility, whether family or otherwise, will have his/ her Fitness Facility privileges revoked immediately and any prepaid fee will be forfeited. This disciplinary action will also be taken against any Licensee who abuses his/her Fitness Facility membership by demonstrating improper actions or conduct which include, but are not limited to, verbal or non-verbal harassment, destruction of property, theft, assault, immoral or indecent conduct.
12) The Licensee will, upon termination of this License, return to Canderel the passcard to the Fitness Facility provided by Canderel to the Licensee.
13) This License shall terminate automatically if the Licensee shall cease to be a tenant or an employee of the tenant in the said office building.
